Appeals

Policy

The Department will appeal appropriate cases in consultation with the Attorney General's Office.

Procedures

Request for Appeals

If there are concerns about the appropriateness of the court's decision or about a specific court order, consult with the Program Supervisor immediately. Remember not all cases are appealable, but for those that are, appeals must be filed within 15 calendar days.

If the Program Supervisor concurs, consult with the Program Administrator or designee.

The concern must be raised through the DCS Program Administrator to the DCS Deputy Director of Field Operations. The Deputy Director of Field Operations will consult with General Counsel to determine if the court decision or order is appealable. To initiate an appeal, General Counsel will submit a written request to appeal to the Attorney General's Office.
